These Terms apply in addition to our Privacy Policy, which explains how we handle personal information under the Protection of Personal Information Act, 4 of 2013 (POPIA).

Jyoti Jivanam Movement of South Africa is a South African non-profit movement established in 2000, dedicated to food relief, community outreach, and charitable programmes. The Website provides information about our mission, programmes, impact, and ways to support our work.

4. Use of the Website

You agree to use the Website only for lawful purposes and in a manner that:

5. Donations

5.1 Voluntary gifts

Donations made through the Website are voluntary financial gifts to support our charitable activities. Unless expressly stated otherwise, donations do not entitle you to goods, services, or membership benefits in return.

5.2 Online payments

Online card and electronic payments are processed securely by PayFast (or another authorised payment service provider). When you donate online, you may also be subject to the payment provider's own terms and privacy policy. We do not store your full payment card details on our servers.

5.3 Bank transfers (EFT)

If you donate by electronic funds transfer, you are responsible for providing accurate payment references and account details. Donations are credited once received and reconciled by our finance team.

5.4 Tax certificates

As a registered Public Benefit Organisation (PBO No. PBO 930032411), qualifying donations may be eligible for a Section 18A tax certificate under the Income Tax Act, 58 of 1962, subject to applicable requirements. Issuance of certificates is at our discretion and depends on the nature and documentation of the donation.

5.5 Refunds

Because donations are voluntary gifts, they are generally non-refundable once processed. If you believe a donation was made in error, contact us promptly at office@jyotijivanam.co.za. We will review genuine errors on a case-by-case basis. Nothing in these Terms limits your rights under the Consumer Protection Act, 68 of 2008 (CPA) where applicable.

6. Contact Form and Communications

When you submit our contact form or communicate with us, you agree to provide accurate information. You consent to us using your contact details to respond to your enquiry and, where permitted, to send relevant updates about our programmes. Electronic communications sent by us in response to your enquiry are deemed received when sent to the email address you provided, in line with ECTA.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under South African law, including liability for fraud, wilful misconduct, or gross negligence, or any rights you may have under the CPA where applicable.

These Terms are written in plain language as encouraged by the CPA. Where any provision of these Terms conflicts with a mandatory provision of the CPA, ECTA, POPIA, or other applicable legislation, the mandatory provision shall prevail to the extent of the conflict.

You agree to indemnify and hold harmless Jyoti Jivanam Movement of South Africa against claims, losses, or damages arising from your breach of these Terms or misuse of the Website, except to the extent caused by our own wrongful conduct.
